Title & Registration, and Auto Industry Division Form Changes & Updates



The following forms are approved for use by the Motor Vehicle Statute Review Committee and the State Registration Section, or the Auto Industry Division and the Dealer Board. FTC Buyers Guide
(effective 01/28/18)



Buyers Guide - This form is mandatory for used vehicles. Exceptions are motorcycles, agricultural equipment, and vehicles sold for parts if the title is marked "junk". For full instructions, read: The Dealers Guide to the Used Car Rule



DR 2174 Secured Power of Attorney

DR 2174 - This is a soft roll-out, meaning you can use up your old forms before using the new forms.



DR 2698 Verification of VIN

DR 2698 - This form is mandatory for all vehicles being brought in from another state or another country.

DR 2043 Off-Premise Permit Application

DR 2043 - Off-Premise Permit Application must be applied for at least 14 days in advance of the event.





DR 2097 Examination Affidavit

DR 2097 - Exam affidavit must be signed and submitted by all new dealer, wholesaler, and salesperson applicants.



DR 0024 Standard Sales Tax Receipt for Vehicle Sales (revised 08/24/21)



The DR 0024 must be submitted to the county clerk along with the titling paperwork before title and registration can be issued.



DR 2174 - Instructions to complete Secured Power of Attorney



DR 2174 can be used for title assignment if issue date of a surrendered title indicates the title was issued prior to the date of the sale. The seller(s) must sign the surrendered title releasing their interest. A Secure POA may be used/however, the seller and buying entity must also sign the odometer disclosure on the surrendered title. The buying entity shall NOT sign the surrendered title on behalf of the seller using a DR 2174 POA to acknowledge the odometer disclosure.


If the issue date of the surrendered title is after the date of sale, or the title shows a lien and the lien was released after the date of sale: The seller(s) signature of a DR 2174 POA is sufficient to release the owner's interest. The buying entity must sign the title on behalf of the seller, releasing the seller(s) interest and acknowledging the odometer disclosure, and must also sign as the buying entity.


A signed reassignment document will not be accepted unless accompanied by a correctly executed title.





Title Delivery - SB 16-140



Dealer's have 30 days to deliver title, no matter what. SB 16-140 provides a defense for non-delivery of the title, if the late delivery is due to actions or inactions of others, beyond the dealers control, AND at a minimum:
The dealer has mailed the loan payoff in a reasonable amount of time
The dealer has contacted the lender and taken any necessary action to obtain a title, free of liens
The dealer has taken steps to obtain any information or signatures needed to obtain a title
The dealer has submitted all necessary paperwork needed for the new title to the authorized agent
The dealer has corrected any errors in a reasonable time frame

This bill also allows dealers to issue a second 60-day permit to the customer.

BEWARE - It is a misdemeanor if the title is not delivered in 30 days. The above defense is only valid if the dealer has taken all steps in their control to obtain and deliver the title or duplicate title, free of liens.

Also, the Auto Industry Division has access to the information on all second temporary registration permits issued. Ensure that second permits are only issued when the above title criteria is met. Track all actions and dates whenever a title problem occurs.
